Draft — Attorney Review Required Before Publishing
Important — Read Before Using the Platform

Intero Performance, Inc. (“Intero”) collects, processes, and analyzes biometric and health-related data as part of the Platform. This disclaimer governs your understanding and agreement regarding how that data is used and what it does and does not represent.

1. Nature of Data Collected

The Intero Platform collects the following health-related and biometric data:

  • Heart rate (HR) — manually entered or from connected wearable devices
  • Heart rate variability (HRV) — manually entered or from connected wearable devices
  • Self-reported sleep quality
  • Self-reported perceived stress levels
  • Self-reported physical load
  • Self-reported emotional event intensity
  • Self-reported cognitive load

This data is used exclusively for the purpose of generating personalized performance awareness coaching, tracking your individual physiological baseline, and supporting your development arc within the Intero methodology.

2. Intero Is Not a Medical Device

The Intero Platform, including all data collection, analysis, and coaching functions, is NOT a medical device as defined by the United States Food and Drug Administration (FDA) or any other regulatory body.

The Platform is a personal performance awareness tool. The HRV metrics, heart rate data, and self-report data collected and analyzed by the Platform are used for performance coaching purposes only — not for medical diagnosis, treatment, or monitoring of any medical condition.

3. Wearable Device Data — Limitations and Accuracy

Where the Platform integrates with wearable devices (including Apple Watch and Polar H10), users should be aware of the following:

3.1 Consumer Wearables Are Not Medical-Grade Instruments

Consumer wearable devices, including Apple Watch, provide HRV and heart rate data that may differ from clinical measurements obtained through medical-grade electrocardiography (ECG) equipment. The accuracy of consumer wearable data varies based on device placement, physical conditions, software algorithms, and other factors outside Intero’s control.

3.2 HRV Values Are Reference Points, Not Diagnoses

All HRV metrics presented in the Platform — including Rate of Drop, Time Under Threshold, Rate of Rise, and baseline calculations — are performance reference points calculated from your individual baseline data. They are not diagnostic measurements, clinical assessments, or medical readings of any kind.

3.3 Percentage-From-Baseline Methodology

Intero calculates all primary metrics as percentage deviations from your personal baseline, not as absolute clinical values. This methodology is designed for performance tracking purposes. It is not validated as a clinical or diagnostic tool and should not be interpreted as such.

3.4 Data May Be Inaccurate

Biometric data from wearable devices and manual entry may contain errors, gaps, or inaccuracies. Intero does not guarantee the accuracy of any biometric data and is not responsible for decisions made based on such data.

4. Abnormal Readings — What to Do

If the Platform displays biometric readings that concern you — including unusually elevated or unusually low heart rate, HRV readings that differ significantly from your baseline, or any reading that you believe may indicate a medical condition — do not rely on the Platform for guidance. Seek medical attention from a licensed healthcare professional immediately.

The Platform is not designed to detect, diagnose, or alert you to medical emergencies or clinical health conditions. Abnormal readings in the Platform may or may not correspond to actual clinical conditions. Only a licensed healthcare professional can evaluate your health status.

5. Pre-Existing Conditions

If you have a known cardiovascular condition, heart condition, or any other medical condition that affects your heart rate or autonomic nervous system function, consult your physician before using the Intero Platform or connecting any wearable device to the Platform.

The Intero Platform is designed for generally healthy adults. It has not been validated for use by individuals with the following conditions, among others:

  • Arrhythmias or cardiac conduction abnormalities
  • Atrial fibrillation
  • Pacemaker or implantable cardioverter-defibrillator (ICD) dependence
  • Autonomic neuropathy
  • Active heart failure
  • Any condition requiring continuous cardiac monitoring

This list is not exhaustive. If you have any doubt about whether the Platform is appropriate for your health status, consult a physician before use.

6. Not a Substitute for Medical Monitoring

The Intero Platform is not a substitute for any medically prescribed monitoring or treatment. If you have been prescribed cardiac monitoring, stress monitoring, or any other medical monitoring by a healthcare provider, the Intero Platform does not replace that monitoring. Continue all medically prescribed treatments, monitoring, and follow-up care as directed by your healthcare providers.

7. Data Accuracy Disclaimer

Intero makes no representations or warranties regarding the accuracy, completeness, or reliability of any biometric data displayed on the Platform. All data is provided for informational and coaching purposes only.
